Ok here's my story.

Me and my friend were walking around Wal-Marts and he decides to steal some stuff, so he grabs some dvds and takes them some place else and starts to open them and what not, all the time making no big deal and keeping the whole thing pretty concealed. All this time I'm doing nothing, and usually trying not to look at him while he's doing it, since I'm not really into that sort of thing. Well lo and behold, on the way out of walmarts, they stop both of us on the way out and they kinda grab him and lead him to a room. We were stopped outside the doors of Wal Mart.

So here we are in the holding room, and he gives them the stuff he stole and I'm just sitting there. This fat woman is screaming at me that I'm in just as much trouble as he is, that I was looking out for him, and that I'm an accomplice and she saw us on the camera and all this crap. So I tell her bull crap I didnt do anything (in a much nicer way), and she says shes not sure if shes gonna file charges on me but my friend is going to jail. The cops get there and arrest my friend and I'm left with his car, and they wouldn't even let me talk to him long enough to find out what I should do with his car, or who I should call or anything. When I was searching for his car with a cop earlier, to get his license for the officer, the cop started cursing and saying he "wasn't gonna spend all damn day" looking for my friends car, and "awww hell son, you don't even know where you parked? thats so stupid." I was not charged, and only issued one of those trespass things saying i can't go to wal marts or sams or anything like that again.

Here's my questions:
1.) Can officer's curse at you if you are not resisting arrest or causing problems?
2.) Is there any way to get my trespass thing removed, or will they ever remove it?
3.) Did the Wal Mart employees have the right to pull us aside like they did?
4.) If i did not touch the merchandise at all, or do anything, did they have the right to charge me for anything had they wanted to?
5.) Is it any form of abuse that the officers left me with no clue with what to do with my friends stuff by not allowing me to talk to him?
6.) Since I was not charged on the scene, is there any way Wal Marts could come back and charge me with anything having to do with this incident?

Did you ever get any answers on this? Specifically, did you ever find out anything about being allowed in Wal-Mart again? My sister was caught in a similar situation where her friends were caught shoplifting at Wal-Mart. She only stuck around because she was their ride home. She begged them not to and threatened to leave them there. The boys she was with emphatically tried to get the Wal-Mart personnel to believe this. They didn't care and deemed her an accomplice. None of them were arrested. They were all told they would be issued something in the mail to make them each pay $200, including my sister, the accomplice. Also, they were told they are not allowed to go to Wal-Mart for 2 years. If they do go to Wal-Mart, they must be accompanied by a parent (not an aunt or a grandparent) and they must keep a hand on the cart at all times. My sister turned her back and did other things while the boys stole the items. She had absolutely nothing to do with it. She only felt obligated to stay with them because she was their ride. Do we have a prayer as far she is concerned? The $200 fine and the Wal-Mart ban are both icredibly disheartening, especially for someone who doesn't deserve it. I know this is a long time after the original post, but I would love some input.


*Note: I am not trying to say that my sister is completely innocent here. She has her fair share of misbehavior. I do not in any way condone covering your child's actual wrongdoings by pretending they are innocent. My sister is extremely guilty of being STUPID and picking poor friends.
