I was once held in a supermarket for petty theft as a juvenile (17), no charges were made, and no civil demand was made. This took place in Broward County Florida.

Now as a legal adult, another incident has occurred involving larceny, also occurring in Florida. It happened with a friend of mine, we entered the store with no intent to steal, unfortunately my friend decided to, and he left for the exit of he store. I had intent to buy, but when he started to walk away, I had a lapse in judgment, and stuffed the merchandise I was looking at in my bag. I went after my friend to stop him, but we were stopped by LP as we got to the door. In the LP room I was issued a ticket and a court date (as was my friend), and I know the consequences that could follow. I just have two questions: (1) Can the holding in the supermarket above have any effect on the charges? (2) I have been advised by an attorney to plead not guilty in attempt to plea for diversion. Is this a good decision, considering I AM guilty?

"lapse in judgment" aka "Decided to shoplift"

(1) Can the holding in the supermarket above have any effect on the charges?
Probably not, no charges= No record
(2) I have been advised by an attorney to plead not guilty in attempt to plea for diversion. Is this a good decision, considering I AM guilty?
Follow your Lawyers advice, he knows these things. Yes, you are guilty, but pleading not guilty gives your lawyer time to work on a deal.

It's not that I wanted to shoplift, It's just that I panicked. I didn't know what to do. The funny thing is, I had my bag open because I was attempting to grab my wallet, as we weren't far from the cash register. This is something I often do, because I don't keep my wallet in my pocket. Also, the LP said they have us on video, is it still advisable to plead not guilty?

Just to clairify. We are not in the business of giving "legal" advice! That comes from an Attorney licensed in your state/county. We tell you of the laws that "might" apply, plea options that "might" be available, clarification of the criteria for shoplifting and the like. Your defense plans and how you should plead should come from your Attorney. Now if you want a plea deal then yes you should plead not guilty and either hire na Attorney or request a Public defender. If thats the case we might offer some possible options that might prove helpful to your case.
