I have been charged with a PL 165.40 amongst other things, the 165.40 being the highest charge. I walked out of a store with 36$ worth of merchandise and was subsequently taken to the holding room, taken to a local precinct (not central booking), had my fingerprints and photo taken, and was issued a Desk Appearance Ticket (D.A.T.). I have done some research and found that the most likely action is an Adjourned in Contemplation of Dismissal (ACD) if it is the first offense. I have been previously arrested at 16 in Georgia but was not booked in any way, no finger prints, photos, not even court. I am worried that this will F me over, but I'm also thinking that because it happened when I was a minor, I was not put inot the system, and I also told the arresting offices in NY that I was never arrested before. I would think that they would check to see that instead of just going on my word so I'm assuming I am not in the system and therefore have no prior record and as a result my current case will be treated as a "first offense". Can ANYONE PLEASE PLEASE clarify because I am truly, truly worried about this. I will not waste time trying to explain how much i regret my decision. Any and all help is appreciated.

Please watch the words you use. Now if you had no court date on previous action there is no record

I apologize for the use of profanity and thank you for the clarification. I was also in need of advice for the current situation. As a minor in the previous case, I let the adults settle the issue and merely did what I was told. Now that I am alone on this matter I am desperately in need of sound advice, please keep in note that I can not afford a lawyer and am aware that public defenders are not usually provided during initial summons where a plea is made. Once again, any and all advice is appreciated.

Once again if there was no court appearence then there were no criminal charges likely therefore no previous record. It is unwise to pursue this without legal help. If you ask me you plead not guilty or stand mute and request a public defender

Is it possible to contact the courthouse and request a public defender before the actual date of summons?
