I was caught shoplifting in a Walmart in Texas. The items came out to about $20 (I was never told the exact amount). The police came and wrote a ticket. I'm being charged with Theft under $50. I'm going to try to get deferred adjudication but I'm wondering if it will be granted. I received a M.I.P two years ago and took deferred adjudication then too. Is this considered a second offense even though it's my first time shoplifting? What is the typical fine under deferred adjudication? I'm currently a full-time student and unemployed, I heard that it is possible to have the fine reduced if I'm willing to do more community service is this true?

Also, after all of that is taken care of, I know that the charge still shows up on background checks and may make finding a job difficult. Will I be able to get the charge expunged or should I call for a motion of non-disclosure? Which of those processes is easier?

Sorry, I understand a lot of my questions seem silly and I know that my fine is up to the judge, I was just wondering if I could get a ballpark estimate (rather than 'between $50 and $500)

Thanks!

Courts, DA's, Judges etc all vary. If they will increase community service and redice or any of your issues is unknown. You need to talk to your Attorney about this. With a prior criminal conviction that yo took ACD on its doubtful you can get it again on this charge. You should be able to expunge your record after several years ( 5 to 7) talk to an Attorney about this its not a do it yourself job. There might be a slim chance at Diversion or the like if you take action before court. I suggest you enroll in an Anti Shoplifting course like one offered by NASP.
