Evening, and hello. I'm new to the forums, and decided to greet those around before I start... Now, to the point.
Yesterday, I was caught shoplifting at Wal-mart. No reason behind it other then blatant stupidity, and the item in question was a $30 video game.
I was stopped on the way out of the store, presented with the open box and gave the game back before following the security to the backroom. There were no arguments, attempts at escaping, or anything else that could be considered a fight or struggle.
Wal-mart took my information down into their database and called a policeman, the whole time I had a friendly conversation with the security there. Now, once the officer arrived on the scene he immediately approached my grandmother and mother (have recently turned 18, so family is still close) and immediately stated I was on probation and was going to jail.
This made no sense, since I have never been arrested before in my life for anything. Though, he continues to say that I'm on probation. He goes into the backroom, and tells me the same thing. Only after a few more attempts claiming such, he radios in and finds out otherwise, still with the threat of me going to jail.
After scaring the daylights out of me, his 'legal advice' comes down to pleading guilty and begging the judge for forgiveness.
Now, I've heard to never take legal advice from an officer. More so one who badgered my family, and was rude as possible. (More so, mentioning the kind of shirt I had on and asking if I considered myself a 'Juggalo' in a very snide manner.)
Even without the officer, my question stems to if a Lawyer would be able to help in anyway? I'm aware that I am guilty, and I am ready to pay the price, but I also want the fact that I have or 'had' a clean record to support me. (More so if there is any way to prevent conviction or a possibility or expungement. I'm not well versed in law, so, I apologize if I sound ridiculous.)
It was labeled as a misdemeanor as the officer said. And I need to know if I have anything on my side of the field.
I live in Colorado, and am not 100% of the laws relating to misdemeanors.
