My best friend and I decided to move in last November. We began having issues when she began bringing friends late at night, making loud noise. Unable to communicate with her or compromise. I decided to give her my months notice. Knowing she brings friends on weekends to drink and party, to avoid conflict I began to spend all weekends with my boyfriend. When the month came up, I contacted our landlord that I was leaving and inquired how i could be taken off the lease. It came to my surprise that our landlord had sent us already a notice for 30 days to vacate due to loud noise complaints on the weekends. Upset, I called my roommate to ask her of such. She acknowledged such and verbally agreed to pay for the early termination fee of one months rent. I have moved out since July first, gave her the apt keys, thought it was a done deal. The finak move out date was July 10th. I have now received calls from the apts that the keys have not been returned and there is a balance that has not been paid. She claims it's my fault this is happening because i was moving out. What should I do in the horrible situation? She ia avoiding everyones calls, and claims doesnt have money to pay the 14 day rent or the term fee. Should iI pay the balance then sue her? Also, her guy friend had cosigned and I have made him aware of this. Help?
 
Yes, to avoid this ruining your credit and making it difficult for you to rent again, pay the rent and fees. Then you can sue her. I doubt that she will ever pay you a dime (because you will win), but deadbeats like this don't care. She just wants to get drunk, use drugs, and be promiscuous.
Save your reputation and credit, pay it off and sue the bum.

I suggest you pay the bill first.
The entire small claims process can take some time.
Your trial will start anytime between 20 to 70 days after you first file your small claim court case in California.
Oh, and you're gonna love this part, even more.
It will take some money from you to even file a claim.
Here's the breakdown:
If the amount of your claim is less than $1500, your Filing Fee is $30.
If the amount of your claim is between $1500.01 to $5,000, your Filing Fee is $50.
If the amount of your claim is between $5000.01 to $7,500, your Filing Fee is $75.
Now, even if you win your case, in California the debtor has 30 days after entry of the original judgment before they are required to pay you. Keep in mind, that is if they choose to pay you.
But, as she seems like a dead broke deadbeat, collecting a penny of your judgment may never happen.
