I am unsure as to where to file my small claims court case - Lewiston, Idaho or in Washington state. The business that owes me money was in Lewistion, Idaho; however, the business and the defendant now reside in Deer Park, Washington. I have spoken to both the Idaho District Court and the Washington District Court. I was informed by Idaho that if I filed my case with them; got a judgment in my favor that I would have to turn around and file a foreign judgment with the Washington District Court in the Spokane County where the defendant resides. At this point I do not know how much that would be but the Whatman county was $79.00.

So I am wanting to know if it would be simpler to file in the county where the defendant resider which is two hours north of where I live? It would cost me more in gas and possibly more time off work to do this.

You are better off to file in Washington. If you file in Idaho you will have to have it served in Washington and it is likely to be ruled an incorrect venue if the business is no longer there.
