I've been married for 5 years. My husband bought the house we live in now with his ex 10 years ago. We are now refinancing and I was wondering if I should put my name on the mortgage, would it make a difference if we divorced? My husband claims since he owned the house before me, he will get it all. I make more money than him and have put a lot of equity into the house. What should I do, I'm lost?

Well definitely get your name on the mortgage AND the deed. That will give you some protection.

Getting your name on the mortgage won't give you any rights; it may (if you also sign the promissory note) obligate you to pay back some dough.

If you are dumping money into the place, then insist on being on the deed, showing that you own half the place. If he won't do that, then stop giving him money!
