My husband and I have been married for 7 years. A year before we married my husband's father told us we could put a house on a piece of land that he owed because when my father-in-law passes this property will be willed to my husband.
Assuming that the property would one day belong to both my husband and me I agreed to invest in a home to be put on this particular piece of property.
About three years ago, my father-in-law had me sign some paperwork regarding the property. My husband told me that they had decided to go ahead and put the land in our name now instead of waiting for the property to be willed to us in the future.
Unfortunately, I signed the paper without properly reading it. When I received the documents in the mail a few weeks later I sat down to read through them to make sure everything was properly stated, well that is when I found out that I had made a huge mistake.
The paper I signed was my agreeing that I would never have rights to the property. My husband is the sole owner and if he passes the property is to be given to one of his children (from a previous marriage) or to another person within the original family. They do not want the land to ever be owned outside of the family.
I have put a lot into this home and I fear that ever dollar I have invested will be lost if something happens to my husband. From my understanding of the paperwork, if my husband dies I still will not have rights to the property.
Is there anything I can do to change this? Can my husband have something done?
This is family property and if my husband and I were to ever divorce I would not even try to take the property from him. However, if my husband passes away before I do, I would like to think that I would still have my home.
Before moving here I invested almost $20,000 into getting the property ready and since I have been leaving here, I have taken out almost $80,000 in loans that have went towards improving this property. I have a lot invested in this home and this is the only home that my son has even known, I do not want to lose it. Is there anything I could do?
