I have two stepdaughters living in Texas, Their father died without a will. he was a resident of Alabama and he died there. these girls and two grandsons are his only known descendents.
To what portion of his estate are they legally entitled. He has a surviving father and sister. His stepmother and his sister are apparently wanting to take what little he has and dispose of it at their will. How can my stepdaughters assure that they get what they are legally entitled to get?

How old are the decedent's daughters?
If they are over the age of 18, they are his ONLY, legal next of kin.
Therefore, they should inherit in total his estate.
I presume the gandkids are children of his daughters.
Therefore, they do not stand to inherit ANYTHING directly.

In order for them to inherit their dad's fortune they must return to Alabama and gather his belongings.
As he died without a KNOWN will, (intestate) they will probably have to begin probate proceedings.
They might wish to engage an attorney to ensure there is no hanky-panky with their beloved father's wealth and riches!

The girls are 27 and 30 and , yes, the grandchildren are the children of one of his daughters. The deceased had no other known decendants or next of kin. I had advised them to contact an attourney in Alabama to help them with probate.
They are currently planning to return to Alabama to handle property issues shortly, but I think it would be best to be represented immeadiatly.
Thank you for your reply. the information is appreciated.
