My sister recently was accused of stealing at her retail job. She was brought in to talk with two Loss Prevention employees. They accused her of not ringing up merchandise and putting it in people's bags. She denied that this had happened but they insisted that they had proof and that she had done it. They also said that they would take her to court and sue her for $3,000 if she did not confess. One of the loss prevention people got very aggressive with her and she started getting upset and scared. After berating her about this matter, she ended up confessing and they then made her sign something. She has worked for the company for 8 years and has never had any problems before this. She confessed because she was scared and in shock of what was happening to her.
I am wondering if anyone has any advice that I can give her about what she needs to do next. I know that she needs to get a lawyer but what are the steps that typically follow this kind of event. Any help is greatly appreciated. Thank you

I am guessing this is a lot of money she is accused of stealing. This might take her case to felony levels. This could mean prison. Yes your right she needs a Lawyer. If she is indeed innocent then have her ask her Lawyer to seek the evidence against her through discovery process. Not to upset you but its rare for a Loss Prevention team to be wrong about case this large. She needs to not talk to Police or LP at all anymore without her Attorney present. She should also discuss the confession she signed. Duress may not be used if there was no threat. The Law suit "might" be considered a threat but her Attorney will know for sure

I am her sister. I really had no idea this was coming at all. It is $3000 they want me to pay back to the company. I tried a few times to truthfully deny that I stole anything of passed off merchandise to others, The LP agent would not believe me and told me he would take me to court and have the police come in and take me away. He kept insisting that I had stolen and they could get proof. After this I was so scared that I made a false confession and agreed to pay the money. For whatever reason I thought that would make things easier, if I just gave them what they wanted. But now I am stuck paying $3000 that I should not be and terminated for a reason that was not true. I admit I have made mistakes about a few things I should not have done, but never anything this large and I have never stolen merchandise. I have talked about this to a lawyer I know and was thinking of going back with him to talk to the LP manager that I talked to the first time. Would this be a good idea? I have not been charged with anything that I am aware of. Only terminated.

Odds are if they pulled you to interview you in they have video and other evidence, most Loss Prevention don't just pull you in out of the bule unless they have evidence that you are stealing.

As for you "confessing" to something you supposedly didn't do I just don't buy it.

You say, and I quote: "I admit I have made mistakes about a few things I should not have done, but never anything this large " what would this be? Passoffs but not in the scale of $3000? Discounts for friends?

There is something you're not telling us.

I am in exactly the same situation.I do not even need to explain anything.Exceptt the LP called me on a phone and accused me.Talk to lowers, they have not idea what to do.I was not charged with anything but I wrote a letter, because he threatened me to put in jail. They also want me to pay them $1300 dollars.I do not have this money. Why I pay them if I did not do anything?

alissa: Do you have your own question? Where I agree no one should admit to something they did not do we do not know the details of your situation

I am one of the managers in big retail store.I was called one day and accused of doing fraud cash refunds.I was accused by LP on a phone. He was very rude did not let me even say a word in my defense. He did not give me proof.I was very scared and shocked he told me that if did not write self incriminating latter he will call the police and will put me in jail.I wrote the letter and promised to pay them $1300 dollars.Again it never happened with before, I am one of few people who opened this store 2,5 years ago.Never have any problems.I talk to a lot of lowers, but they all sending me to Human Rights Commission, because I am only minority manager in store.Besides the guy on a phone told me,that only 2 people would know about it my manager and DM now at least 4 people know about it. Please, if anybody can tell me what to do?!

We can help give you ideas in the theft issue. You should not have confessed if you did not do anything! They cannot put you in jail if you did nothing wrong
