Sister will not do probate and I have not seen the will

My father passed away in August 0f 2008 and my mother a few years earlier. I have asked my sister about the estate on several occasions and have always been told that it will be taken care of next week. Earlier this week I pushed a littler harder and the angry response was "The Condo belongs to her and the business is 50/50". How can I force her to produce the documents? Due to the business concerns of the estate I may have to enlist the services of an attorney, my location is in Virginia. At this point, I do not wish to be in business with her.
 
If you have an attorney LISTEN TO THEM. You need to file against the estate, and against her if she has commingled the estate with her own assets. If she thinks she is mad now, wait until the Judge reads the will and she has misappropriated some asset to her own usage. Judges find that annoying.

You should have had an opportunity to see the will before waiving your right to a claim. Did you ever sign one of those waivers?

I have not and will not sign anything before I see any paper work.

She is very lax with paper work but this is something I need to look into.

The will cannot be admitted to probate before anyone with a potential claim (you) has waived their right to contest the will. You will have a chance to see it before it is probated.
