My father passed 2 years ago and left his estate to his wife of 30 years. I found this out after questioning my sister when she was removing antiques from his house.
His wife ( my Stepmother) became ill shortly after and I was told a few months ago that the end was near. I received a call from my sister 6 days after her death last month to tell me she had passed and that my fathers house and all the contents had been disposed of. I was told that the estate was left to my sisters. There are quite a lot of assets involved. I was never told of any will stipulations and everything had been left to them. It appears the house sale was closed on before the will was probated. The house was full of antiques and there is a large piece of real estate. Do I have any recourse here? What if I wanted to contest the will? Don't they or didn't they have an obligation to provide a copy of the will to me before selling off all of the assets? Thanks!

Unless you were mentioned in dad's will, you have no standing. His wife was his legal next-of-kin.

If you mentioned in dad's will, you would have been notified when the will was probated. If you weren't noticed, chances are dad left you nothing.

If dad died without a will, everything would have passed to his lawful next-of-kin, his wife. If you doubt that things were on the up and up, speak with a lawyer.

When your stepmother passed, all of her possessions (including what she inherited from your dad) went to her next-of-kin. I suspect that would have been her sisters.

Even if stepmom wasn't supposed to inherit all of dad's stuff, I suspect it's too late to remedy that, unless you can prove fraud!

These are my sisters not hers. Would they be the next of kin?

Are they stepsisters, half-sisters, or full sisters?

You MIGHT have a little wrinkle here.

Your sisters could have acted fraudulently.

However, they could have been named in the will, and you were excluded.

Or, they might have ripped you off.

You might want to speak with an attorney to see how you can discover what the will actually said about YOU!

If you are all full sisters, and mom died without a will, you should have all shared equally.

However, if mom left a will and excluded YOU, you have no case.
