Hi This is my first time talking about this but would appreciate any help in this matter. I own a house in So. Cal.
In 2004 we received a letter from my backyard neighbors attorney stating a survey has be done and it shows the fence dividing our property is in the wrong location and for us to move the fence. It took us 3 more months just to get a copy of this survey from the attorney, after reviewing the survey we noticed inconsistencies in it. We hired a surveyor who did a survey that showed the fence was on the property line and therefore we should not move it. We had our survey recorded but it took them till late 2006 (2 1/2) years to get them to have their survey recorded. In the mean time I filed a complaint with the state over their survey and they found their surveyor guilt of being negligent, incompetent, not filing his survey in the required time frame among other violations.
Their attorney hired a second surveyor whose survey said among other things was that not only was the fence not on the property line but that our entire building and every building on our block was built 3" onto the city sidewalk. His survey did not referenc any previous surveys except a piece of paper from 1934 that had a drawing on it. This second survey was done in 5/06 and over a year later he still has not submitted his survey to the city/county of L.A. for recording. His survey is very plain, no details or measurements except the front of my building the rear fence of my neighbors. He set no monuments or anything.
I would like to know if I have a case of slander of title against either of the two surveyors. I have spent thousands of dollars defending against what I think is fraudulent survey(s).
