I lost a small commercial claims case. The claimant was invoicing me for purchase made by an employee who now no longer works for me. I demand proof of purchase such as my company purchase order copies which they can't provide, and one invoice are actually duplicate billings, the total amount was $9000.00, they separate it into two small cases. The cases was heard together by the arbitrator, the arbitrator spend 20 min listen to the claimant and listen about 10 min to my defense, and it was 9pm and she suggest we should adjourn, the claimant was strongly oppose to it, so the arbitrator said she will just decide it based on what she had heard so far.
It come as a shock to me when the judgment come in award the claimant almost the full amount of $7356. Can people actually file two cases to collect over $5000? $5000 is the NY Small claim court limit. Lesson learn on my end, I will never again to go with the arbitrator route if I know I have good defense. They can make a decision based on sympathy, or if they are racist and you can do nothing about it because their decision is final. Please post your comments! Thanks!
