I have not been able to find much out about this topic via the Internet so I appreciate any advice that you have. I live on the second floor in a condo that my wife and I own (in CA). The unit below shares a ventilation system in the bathroom with us and we are constantly getting her cigarette smoke in our restroom. The smoke is also coming up through the floors and into our kitchen. We have spoken to her on several occasions about her smoke and how it is affecting our health (we have a 1 year-old and my wife is 3 months pregnant) and things will get better for a few days and then be back to normal or even worse. Our HOA is unwilling to do anything about this issue as well.
I know very little about legal terminology (so forgive me if I use the term incorrectly) but is it possible to seek an injunction to keep her from smoking if it is affecting the health of my family? If that is not possible are the any other alternatives to try? I really appreciate your time and advice!
