smoking

I have just moved into an apartment on the 1st of April. I signed a 1 year lease. Upon reading the lease it stated "no smoking". That's ok because neither my daughter or myself smoke. However, the apartment attached to mine has 2 people that smoke like chimneys. Because it is an old farmhouse the smell comes through the walls and makes everything in my apartment stink like a bar. The first week I was here I spoke with the neighbor and explained I have health problems that would be affected by cigarette smoke. She understood, or so it seemed. I also mentioned this to the landlord and she was surprised at the fact they were smoking. The man uses oxygen and should not be smoking for obvious reasons. The couple that live there are the groundskeepers and have been there forever. So.....
Do I have a legal right to break my lease with no repurcussions because of this??

Just adding to the previous comment, I would send the landlord a certified letter requesting that she remedy the situation. If nothing happens, then you can ask your landlord to release you from the lease without penalty. She may or may not agree with your request but it will either prompt her to act one way or the other. Good Luck!

Thank you for you answer...Update: My landlord did release me from my lease, and apologized for the inconvenience that was caused.
