Sold Vehicle. New Owner Wants Refund.

FIRST OF ALL IF THIS IS IN THE WRONG SUB FORUM PLEASE MOVE IT FOR ME MODS.


Ok my story. I sold a motorcycle on the 6th of june 2010.

Around 1-2weeks later the new owner rang me stating the vehicle is unroadworthy and he wanted a full refund.

This confused me as the last time it ever had any major work done to it i had it put through an MOT.

From what i gather reading the limited info i can find it is illegal to sell an unroadworthy vehicle BUT did i have to know it was unroadworthy?

I honestly thought it was roadworthy as i had the CERT to prove it and i had been riding it since the work was done.

All the work on the vehicle was carried out by the same garage from whom i bought it.

I'm not sure where i stand and if whether or not it is up to me to refund his money.. or if he has to argue it out with the MOT centre for passing it or the garage who did the work.


Any advice would be muchly appreciated.

Things may be difference in UK, but generally it is the responsibility of the buyer to determine these things before making the purchase. Once the sale is done there is no turning back.
If the buyer wants to take you to court he will have to prove that you knowingly sold a vehicle that was not road worthy, and will have to explain his own failure to inspect the vehicle prior to purchase.
Don't pay the money unless a court orders you to. For all you know, the new owner damaged the vehicle after purchase.
 
yeah thats the bit im hung up on, whether or not i had to know it was unroadworthy.

I'm also looking at this from a US standpoint, but if this were here I would tell the guy that it was roadworthy when it was sold, you have the inspection to prove it. You have no way to know what he did with the bike after it left your possession.
 
yeh i feel sorry for the guy but ive helped him out and forwarded his email stating that it was unroadworthy to both the MOT centre and the garage and informing them to send any further correspondance to the new owner.

this i think is fair as he legally now owns the bike i have no power over it any more anyways.
