Some help please

My Husband and I are being sued in Civil Court by a bank credit card. I owe 1700.00 and my husband owes 3700.00 We were unable to pay because he was injured on a job (He's self employed) and I am a diabetic with many complications.

My Questions are...

Do we need a lawyer to go to court?

We do not really own anything but our home(We owe 205.000) and a 9yr old Durango.We have no equity in our home.

What is the worst that will happen?

We did hire a place to help us consolidate all our cards Back in Sep 07 and they don't seem to be willing to work with them.

We live in NJ

if you have no assets, no income (and thus no ability to pay your creditors) file bankruptcy. you will get to keep your house and car. otherwise i would pay them. they can seize your car and lien your home after judgment (depending on what state you live in)

No, you dont need a attorney-- you need to go to court and explain that you are short on money and can afford X amount of dollars a month
