Shoplifting, Larceny, Robbery, Theft Some questions on a pal of mine caught shoplifting at a Macy

Um, Hello everyone...

A friend of mine 23 years of age got caught shoplifting at a Macys here in the state of Texas, it was some earrings and a necklace worth 90$ together. (There was no arrest or police called and involved as far as I had seen,) but he had told me they got down his social security number, drivers license, phone number and took a picture of him, and he now has a fine to pay. He is also ban from the store for three years.

I have some questions about what will happen after he pays his fine, that civil demand he had got:

1. Will they eventually decide to inform a cop and he/she will come to his door step and arrest him or give him a court order sometime after?

2. Will they inform other stores that he's a shoplifter?

3. What will his picture and social security number be used for?

4. I know they have his record in their database so will this come as a criminal record for him also?

I've yet to learn more about the laws here in TX, and never had many experiences on laws for shoplifters, please forgive me if these questions seem much alike previous ones.... This situation has made me deeply worried about him. I so very hope he learned his lesson...

Possibly, we share info with other stores

Reports and possible police report.

No unless he's charged.

His criminal record is clean so far, so it's load off my back, such as long he pays the fine, that from what I seen I'm sure he will.

I am wondering, how would you rate the possibility on question #1? Considering the store and state...

I can tell you his parent did talk with the security after, and she said something like "the way he did made it look like this isn't the first time." But yet "they were trying to be nice about the situation" his parent told me. I know from what I do know of him this is first offense ever for anything.

And let's say years from now, will they decline him a job in retail stores then on? Because of the record of course...
 
If I had to guess (its only a guess) once he pays Civil Demand its over. Working in retail is no tlikely if he was put in a retail theft database.
 
I seriously appreciate these replies, much thanks Admin! He sent the Civil Demand just a day after he got it. It's a relief to a degree that I see now it probably should not get anymore serious, but sad he has a record now, yet it is fair, and good influence it should be for him to work harder on bettering himself from ever doing such a thing again.

Ok, thanks for letting me know about that, I'll see what I can do in it as soon as I can.

Um, I have three more questions that popped in mind yesterday after I was talking with my pal... It's based on no facts I currently know of, but just an idea I had: If a person had shoplift a few items over 100$, and leave some evidence within the store in random places like tags, yet no one (theoretically) saw, and the theft got cleanly away from the store, once workers would find the odd missing item's tags, they go and backtrack through camera tapes to find who it was to check where it came from? I'm talking about like the famous retail stores.

Now in my second question: let's apply this to my friend, I don't know if he was stealing in the past before this time of course, but if he did, (and I'm 99% certain he in theft database now,) after (if they did) go through the camera tapes, would they search the database to find a match in looks and he may get "a knock at the door" eventually?

My last is, I do also still tend to consider the real situation with my friend: I wonder if they would backtrack through other store tapes? Since the security person actually told his parent the way he did his first offense was "pro"... So it left me something to creepy to think about when i do...

I know there is lots to consider when it comes to many factor's depending on the actual worker choice of actions, etc, so think of these questions as wanting to know what generally (most of the time and at rare times) what the workers and security in these type of stores and situations do, in above questions...

Please to anyone to take your time to reply to just me. I wish I was more experienced in these matters, yet I've learned alot these last few days from browsing this forum site and the replies to me here, wonderful in my opinion, especially in these hard times. I'm not sure when I'll check back to look since the Holidays over here have me away at times, so just in case: deeply much thanks in advance! :)
 
Item 1: Can they review tape? If they have it yes however if store was open for 12 hours then somone must go through 12 hours of video. Not likely. Even if they did they first would have to have video that covered all the "steps" store policy says they "must" have to arrest. again unlikely. Last and most important even if they have video and have enough for successful prosecution they need to have a means to ID the suspect. Once more unlikely.

Item 2: If the store was already a subscriber to theft database they would have ran that at time of stop

Thanks admin for this! Turn's out I found some time for net so I was eager to come check back here.

I have one last question... Since my friend is (ironically...) actually looking for a job, will his record be in the Retail Theft Database forever? Just like Criminal Records work.

He's been pretty traumatize by the matter, to the point he doesn't sleep at most nights, etc, so sure hope he will work much harder to live much more honest from now on, I had not told everything you all shared to me in this thread though, he's a very good guy to me, but I want be keeping an eye on him for the moment on.

From what I understand his name will remain on database for about 7 years. Keep in mind we do not who subscribes and who does not. He can always apply and if they do he wont be called for job. If they dont he could get job. Remember when he fills out an application long as he was not convicted he can legally say no when asked about criminal past (if any)
