Someone hit us than ran!

My husband, 2 year old daugher and I were stopped at a light in our 1 month old Civic Hybrid today when someone rear ended us. My husband saw the person that hit us reverse in an attempt to run, but he managed to follow him for about 3 miles before the other driver gave up and pulled over. (Yes, we are VERY lucky the other person was not armed and dangerous!) When he got out he told my husband he was sorry and was scared.

When the police came, and after he was arrested, we found out he does not have a license and the car was not his. The car is insured, but the owner was not with him as he was alone.

My husband and I are experiencing neck and back pain already, and it actually feels worse as time goes by. I am worried about my daughter as she can't tell us if something hurts, so I am taking her to the pediatrician tomorrow.

My concern, is this other person's insurance company is one I have never heard of (American Access) and it's only office is located in Illinois. We live, and the accident occured, in Phoenix, Arizona. My question is what we can recover from this company? How do we go about having them pay our medical bills? How do we go about getting compensation for pain and suffering? Can we get compensated for the depreciation of our car since it is only 1 month old and was involved in an accident?

Look to your insurance policy. Can you make a first party claim on your own insurance? That's probably the easiest thing to do. Your insurer can then turn around and collect from American Access.

If not, you file a third party claim with American Access yourself. Good luck with that! I've heard they're terrible.
