Son threatening to sell daughter's car!!

I am so desperate! My daughter had to purchase a car in her brother's name because neither she nor I have a license. She was going to use the car to obtain her license. Now, my son is threatening to sell the car and keep the money for himself. I know the car was purchased with her money because they were Social Security benefits (from her deceased father) that were received for her in my name. Is there anything we can do to prevent this or recover from it? I am so scared for her. He refuses to sign the car over to me so that I can rectify this situation. We have not yet received the title because the purchase was recent. What in the world can we do? He has been living with us, refuses to get a job and my husband (stepfather) and I have been supporting him. I am so sick about this. Can anyone please help? Also, how can we obtain insurance for the car w/o doing it in his name. This is such a mess and my daughter and I are desperate. Unfortunately, my son would probably do this.
 
If the car is titled in your son's name, there is nothing legally you can do. This is indeed an unfortunate mess. Hopefully your son may realize that family is worth more than riches.

As long as the title is in HIS name, it is LEGALLY his car.
Therefore, HE can LEGALLY sell HIS car.
What you say may be entirely TRUE, nevertheless, the law sees him as the legal owner of the vehicle.

How can you rectify the situation?
You have but one LEGAL remedy, get him to sign the title over to you or your daughter.

You were foolish to let him use YOUR money to buy a car in HIS name.
You don't need a drivers license to own a car.
A drivers license allows you to drive a car, not buy one.
Many people own cars and don't possess a drivers license.

Now, if your license was revoked or suspended, that may impact your ability to own a car in some states.
It is always wise to check your state's laws with the state agency that regulates titles and drivers licenses.

I told her it was foolish but she was gung-ho and wouldn't wait. He is living off me and my husband, refuses to get a job, etc. I am just heartbroken and sick that this is happening. The dealership told her she had to have a license to buy the car. Any recourse there?

You'd have to prove they said that.
And, even if you did, what are your damages?
If PUSH comes to SHOVE, I suspect they suddenly get amnesia.

You would have been better off titling the car in YOUR name or your HUBBY'S name!
Hindsight, right?

What you should do, is put the deadbeat, wayward, lout of son out of your home.
I'd start eviction proceedings against him today.

Maybe that'll wake the bum up?

He is threatening to do this because she refuses to give him money out of the money she has left for the car insurance, tag, etc. Do I have a blackmail case?
 
You have a civil complaint.
If he sells the car, and you can PROVE that she paid for it, you might be able to get a court to order that he pay her back.
I am guessing you don't have any valid proof though or else this situation wouldn't arise. You can try though... he might say something stupid to a judge and will defeat himself.

I suggest you evict this deadbeat.
Why do you allow him to stay in your home?
