Sons full name was used in an id discovery show without my consent

Id Discovery aired a tv show called "Murder Comes to Town" a case where my sons ex girlfriend was found murdered in the woods behind our house, my son was a suspect at first but 3 weeks prior to the murder a drive by shooting occured at my residence where my son was the target. Long story short my sons ex girlfriend had one of her boyfriends do the drive by and then the kid murdered her for talking about him doing the drive by on my house. There was also an episode of the "The First 48" done on this case where I would not allow my son's name to be used. As I am watching this show last night I was shocked to see this was about the same case. They threw my sons full name all over the TV making him sound like the murderer, portrayed him and myself very poorly and the facts were incorrect. THIS WAS ALL DONE WITHOUT MY KNOWLEDGE nor MY CONSENT. My son was a minor when this occured in 2012 and now has an outstanding military career that this could damage. Just by the way he was portrayed. I thought all of this has been put to rest but they just brought it all back up. I would like to know my legal rights as I want to sue them. My son was also a victim in this case and was portrayed as the top suspect until a witness came forward. Anyone who would have stopped watching the show mid broadcast would have believed my son commited this murder...I am very upset about this.

If its a matter of public record, police investigations are, it's not protected.

Court proceedings, and the attendant testimony is also protected.

It's genesis is rooted in English common law.

There are exceptions.

If your son was a minor, he might have the right to call for a retraction.

You don't, mom, as he's no longer a minor.

If there is a legal remedy, sonny boy must initiate it.

The good news is, as you said, your son was never convicted.

Advise Junior to speak with a lawyer, so he can determine if he has recourse.

Finally, madam, I'm just another nut job volunteering to help others on the Internet.

You are free to speak with a couple attorneys in your county to discuss this matter and determine if one of those lawyers think you have a case of action regarding this troubling business.

The saddest thing to me is that a woman is dead.

That's very troubling, and truly senseless.

Rape, murder, child abuse, child neglect, and child molestation are the five worse crimes; as well as the most senseless crimes. They're all so very sad.

I remember this case. The murder took place in Katy, TX. The people involved weren't bad, as it is in most cases, misguided. However, it went off the tracks somehow, and ended in a senseless murder.

Sadly, lives were destroyed forever. Sometimes, I hate what people do and the hurt it cases others.

I'm so sorry this hurt you, too, madam. I'm happy to hear Junior is on a upward path. I wish you will, but the decedent will never get a second chance, her dad won't, either; nor will her loved ones and family. Senseless, stupid, idiotic, painful.....

Thank you very much for your imput, yes lives were dystroyed by this sensless act one almost being my son's life lost because of jealous highschool games, I also had to testify against the kid that murdered the girl and shot up my house. This kid did not know my son and this was done as a "favor" for the deceased. I sat several days with her father during the trial I even knew him personally when our children were dating. I am sorry for his loss, but thankful that my son is still alive because of her selfish actions he could be dead. I was more curious if this would be considered slander or defimation of character even the way they protrayed myself saying I said terrible things about my own son that were not true. The whole side of our story was portrayed incorrectly, we did not "disappear" nor leave town. I spoke with an officer the day her body was found behind my house (hence set up by a guy to make it appear as my son commited this act) I was there that day and the house was not empty. I also contacted the HCSO Homicide division when her name was released on the news knowing that the shooting and her death were some how connected as my son had heard rumors that she had something to do with our house being shot up. HCSO did not seek me out, I contacted the Homicide Division directly that very day. I guess I am upset that we as a family were portrayed as "running from the law and me basically a dim wit that talks trash about my own kid making him sound like a terrible kid in which he was not! They contacted and interviewed my neighbors with their consent put them on TV but yet didn't reach out to the people actually involved in the case and can just air false truths and slander someones name without their knowledge. My son contacted me last night very upset that his name had been put out on national TV without his knowledge and he was made to look like he commited a murder, when he was also a victim in this case and could very well be dead because of the actions of his ex girlfriend...This affected him mentally as well and he had to seek counsuling to get thru it and now for it to be brought back to life in this manner is just wrong on behalf of that network. They have no idea how this could impact his life now. JUST STUPIDITY AND DOWN RIGHT WRONG ON THEIR PART! as I said before thank you for your imput.

I'm still not seeing the legal issue.

The network apparently aired a "true crime" show.

Sure, they can mix and match before the show is aired, but they're not telling falsehoods, are they?
 
I kind of agree with Proserpina. There are many "true crime" stories on TV. It's news/journalism. However, your son can certainly speak with a lawyer.
