Speeding ticket-CHP- I-8

I know this is long but I had to explain. If I do fight this with a written decleration, If I am found guilty can I then take the traffic school and lower fine? or will that option be out the window thanks......


I was on the I-8 freeway at 8pm, traffic was light for a Friday evening. I was in the far left lane and because I was coming from a Casino about 30 miles away. I was reported doing 82 in a 65. I have evidence of when I left so I can calculate how long it should of taken me to get to the location where the officer said I was speeding. I can use this to my advantage so I can prove I was not speeding all the way and got caught finally. I am not someone who speed and weaves in and out of traffic. I was going with the flow, which was around 70 or so mph. Like I said traffic was light but there was still cars out it wasn't just me. My exit was coming up in about 1.5 to 2 miles. I had to get over. I had my blinker on but the cars to my right would not let me over. I had several cars directly behind me and had plenty of room in front of me. I decided the safest, most efficient way for me to get over was for me to accelerate so I had room to make a safe pass. When I finally got over one lane I stayed there for a few moments then got over one more time. I used my blinker on both passes. Right after the passes I noticed the lights behind me, my first though was not that I was getting pulled over. My first thought was it was an ambulance, because I knew there was one behind me from a few miles back and I only saw red and white lights. So my instinct was to get over so it can pass, there was a car to my right, so I increased my speed to get over in time. When I got over I realized that he had not gone by and that he was pulling me over. So I was trying to find an exit, I just moved here in July and was not use to the area. I found a spot on the side of the freeway and pulled over, I was hoping to get off the freeway because it is safer for both of us. I was between the freeway and a entrance ramp, not the best place, over his loudspeaker he told me to go forward more, I did. When he got to my car he asked why I got over the way I did with no room behind me. So I explained. He thought I was going to try and run. He gave me a ticket for the speed and my tint, I am from Vegas and never had a problem with the tint. He never explained what speed he had me going..

One exit before, from where I believed he was sitting There was a car that was going at a much faster rate. I believe that he picked out my car because I was getting over two lanes, and also because of the type of car, a 2000 Civic Si (racer). Even though nothing was done to it.... Me being only 18 didn't help either.



He made my tint non correctable so I have to pay a fine. I wasn't sure If I had to take it off. I was then pulled over by another CHP officer about 4 days later. I told him about my other ticket and that it was non correctable. He was much more informing and nicer. He explained what I had to do ect ect. He gave me a fix it ticket because I did not have the other one in my car. The speed on this ticket, same freeway same general area was 65 mph. Does that help me?
 
You were not cited for speeding for 30 miles. You were cited for speeding at the time the officer clocked you. You admit you were speeding beyond the prevailing speed of traffic. You should have removed the illegal tint in July.

No, you can't use this to your advantage. You could have driven 120 most of the way then slowed down to 30 for awhile and been in the same place at the same time. What you are suggesting makes sense, but it is not evidence of anything that will help you with this.

70mph in a 65 zone is still speeding. Just because everyone else is exceeding the speed limit does not mean that you should.

You decided wrong- if you have to exceed the speed limit to pass another vehicle then you should not be passing.

The speed should be listed on the citation. It sounds like the officer caught you accelerating past the other vehicles as you approached the exit. As you describe it, it sounds like a very valid citation for a violation committed right in front of the officer. If you have moved to California then your vehicle needs to comply with California laws. Your legal tint in NV may not be legal in CA, and you will have to modify or remove it.

You won't get anywhere with the mistaken identity argument. The officer followed you as you accelerated and changed lanes.

I believe so too... it sounds like you were making unsafe lane changes near the exit. You should have merged sooner and not exceeded the speed limit.

If you get the tint corrected and bring evidence of the correction to court it is possible the judge will dismiss that portion. You are on the hook for the speed though. Take a traffic school class and learn to drive a little safer out there. From what you describe it sounds as if a little planning ahead so that you were in the right lane well in advance of the exit would have saved you a lot of trouble.
