Hi,
I recently received a speeding ticket in NJ (I-495) by a Port Authority of NJ/NY in Hudson County, NJ. I received a ticket for 20 over the speed limit (doing 70 in a 50 MPH zone), however the officer checked off the box which states I exceeded the speed limit by 25-29 MPH. So, there are two conflicting allegations on the ticket (one allegation states I drove 20 over, the other states I drove 25-29 over...)
Additionally, while the officer told me he clocked my by radar (he was parked on the side of the highway), he didn't mark that on the ticket (there are boxes for Pace, Radar, VASCAR, etc).
I know judges won't dismiss tickets based on basic clerical errors, but do I have enough conflicting errors that may help me get my ticket dismissed?
My argument would be:
1) Based on the officer's comments, it's unclear what my speed was. I'm not sure I was even speeding
2) How does the officer even know how fast I was going? I wasn't paced (he was parked on the side of the road), and I'm not even sure he used a radar on me, since nothing is checked off...
Do I stand a chance???
