Speeding Ticket in WA State

Hi,

Today, around 4pm, I was pulled over on I-5 NB for speeding. I'm a 28 y/o female, and was driving a 95 honda civic hatchback.

I was driving along in the middle lane of traffic heading through Everett, WA on the freeway. I was following behind a car going 50 mph (limit 60 mph). Traffic was heavy, but everyone else was managing to go the speed limit. After being behind this vehicle for awhile, I finally get a chance to go around. I pass, speeding up to the speed limit - at most, 65 mph. Maybe 3 minutes after I passed this car, a police SUV comes flying up next to me, passes me, then hits his brakes, gets behind me and pulls me over. I was pulled over by a Snohomish Co. Sheriff, not a WA State Patrol.

The officer comes to my window, demands my license and registration, and then tells me he pulled me over because I was driving like a "bat out of hell". He would not tell me the exact speed I was going. He then started asking me questions about where I worked, what I did, and what my work phone number was. In all the times I have been pulled over in my driving life, I have never had an officer ask me anything other than questions pertaining to the situation at hand. At no point during our conversation would the officer tell me the speed he thought I was going (and yes, I asked).

He issues me a ticket for $124.00. On the ticket, he does not list a speed. Instead, it says, "Exceeds the safe and posted speed limit of 60 mph." He did not use radar, he marked "Pace". He did NOT pace me. He came flying up out of nowhere and pulled me over. When he first pulled me over, I thought maybe he had gotten me on radar when I passed the slow car, and maybe I had sped up a little more than I had intended. Now I really don't know what was going on. I'm guessing he maybe mixed up my car with another? Black honda civic.. not exactly rare. Regardless, I don't feel I should have to pay this ticket. I don't believe I was exceeding 60mph (and if I was, it was just barely).

In my opinion, he can't prove my speed. He didn't use radar, he didn't record a speed onto the ticket. I'm going to court to contest this, but I am nervous about my chances. I'd like any advice that anyone has to offer. Thank you for your time.

You are right, he can't prove your speed, and that is why he didn't write it on the ticket. Instead, he cited you for the safe/prudent violation which essentially means you were going to fast for conditions, though possibly under the limit. Was it raining? Was visibility poor?

If not, when you go to court, you will have to pose questions to the officer that make him explain how your driving was unsafe and how your speed was determined. You can also make a significant issue out of why your speed was not listed on the citation if he had determined you had exceeded the limit. How is the court to determine your fine if they do not know how fast you were going?

It is very possible that this officer will not show if you go to court. As you present it, the citation sounds weak. A lot of people just pay the fine rather than go through the hassle of court, and that might be what he is hoping you will do.

If you go to court, be prepared.
 
Thanks for your input. It was a clear, dry, beautiful sunny day. Visability was excellent, and the road was in great condition. I am totally stumped as to why I was pulled over, and then why I was given a ticket. I actually look forward to taking this to court.
