Speeding ticket

If I speed up to pass a vehicle who you feel is drivivng recklessy, and get pulled over as you're slowing down and given a ticket for going 10 over in a 30 can you fight it? This is on a road going east and west and in the west bound lane there are two lanes of trafic. At first the truck in front of me was driving in both lanes and apeared intoxicated. As soon as they got in one lane i got in the left lane accelerated untill I was passed them then started to slow down. directly after that I was pulled over for speeding and a out head light and giving a speeding ticket. If I can fight this I would like to know where I could find information with similar cases to bring to court for proof of my innocence.

You can fight it, but you won't get anywhere doing so.
The speed limit is the limit... you are not supposed to exceed it for any reason, even to pass. If you can't pass without exceeding the speed limit then you should not pass.
See about taking traffic school and you can keep this off your record.
 
Thats what I thought but wasn't sure I just wanted to know before i went to fight it, so I have been looking in other directions. On other law sites I have looked at say you can ask to subpoena for the calibration records for the radar gun. Do you know if I can do this in Michigan, and if so how often is it required to be done?
 
If you are going to go down that road you had better get an attorney to assist you. You have a slim chance of defeating the citation that way. You would pay a lot less to cough up the dough for the citation than paying for an attorney AND paying for the citation.
Assuming you have not had multiple other violations and you aren't at risk of losing your license, your best bet is to request traffic school. Pay the fine and pay for traffic school and the citation will stay off your record and not effect your insurance.
