I just got a speeding ticket, and the officer said he got me on radar going 62 mph in a 45 mph zone. Looking over the ticket, I noticed that for approximate speed he wrote 62 mph, and for radar he wrote 43. Is this enough to get the case dismissed?

In what box was the 43? Could it have been a poorly written 45?

You can try it. It's been tried before. In my experience when it it, the persecutor moves to amend the error.

In this case, expect that to happen, too. How? By putting the officer in the stand and testifying. Good luck, maybe you'll be the first I've ever heard to pull it off.

It sounds like one you should certainly take to court. Make the officer explain it.

Had the approximate speed been a round number like 60 or 65 I would suggest it was based on his observation before getting the radar on you (perhaps you were slowing down as you approached?).

An approximate speed of 62 is not very approximate at all... just show up to court, plead not guilty, and make the officer explain himself. You might get it dismissed before you get that far.

I suspect now that the 43 may have been the speed he locked in, but 62 may have been the speed initially observed on the radar.
