I was driving home from Redmond...and I was absolutely (and I am serious) NOT speeding...I rarely talk on my cell phone when I am driving but I happened to be driving home and I made that rare call.

While on the phone I look in my rear view mirror and see lights...

I can't possibly believe it's me, so I pull over to let the officer go by and then realize he's pulling over me.

He doesn't even ask me if I know why he pulled me over. He just says he pulled me over because I was speeding. I politely said that I wasn't speeding. I gave him my license, proof of insurance, and title, and he also informs me that our conversation is being recorded. He actually was nice...but then issues me a ticket for $132.00.

He said I was going 42 in a 30mph zone. I asked him to see the Radar Gun...he said that he doesn't have to show me the reading. I asked why if he is telling me that I was speeding...shouldn't I be able to see the results on the radar gun... he said that he doesn't have to show me.

He said perhaps I was distracted because I was talking on my cell phone. I politely assured him that I was very aware of my speed and my driving skills.

I asked again to see the radar gun. He then stated that it was also based on his visual perception...I pointed out that I had an immaculate driving record and that I was very confident that I wasn't speeding and then asked a third time to see the reading on the radar gun.

He said that I could contest the ticket in court if I chose and that he doesn't lie or he'd lose his job, so therefore there was no reason to show me the radar reading.

I asked if the record of 42 mph was permanently recorded on the radar gun (with the date and time) so it could be retrieved later and he said NO, and that as soon as he used it again on another driver the reading would disappear.

Should I hire an attorney or is this a NO brainer and the judge will throw it out???

If I try to defend myself, should I subpeona the officer, the person who calibrated radar gun, the notes of the officer and the recording???

Or should I just take a deferment and pay the fine and try not to get a ticket in the next year so the ticket will be expunged?

Washington State Speeding Tickets

There is no requirement in any state that the officer show you the reading on the radar gun. It is immaterial anyway since a visual estimation is good enough. You might want to try for mitigation and save the deferment for a serious ticket, if you should get one.

Unless you know what you are doing, don't try to go the challenging the officer, radar calibration route.

What do you mean, mitigation

What do you mean by mitigation...I would rather pay a fine but not have the ticket on my record. Can mitigation get my ticket off my record

I think mitigation reduces the fine/speed. The clerk of court can tell you more. Up to you whether to use up your deferment on such a minor ticket. You only get one every seven years I think. It might be five.
