statue of limitations if landlord wont return deposite

I have been trying to get my money back from my landlord who flat out refuses to return our deposite as well as not giving us reasonable reasons as to why. I have been trying to get this guy served by the state and to be honest are worthless in finding the guy. I have had to track him down myself since he works out of a PO box it doesn't make it very easy. It is coming up on two years since he refused to return our deposite. have I run out of time yet? how long do I have?
Please help I have sunk enough money into tracking this guy down I dont want to continue to throw money at this only to be thrown out of court as this guy quotes some statue of limitations I know nothing about.
