I had to answer a complaint regarding an old debt that is past the statue of limitations in masachusetts. I answered the complaint claiming that the statue of limitations had expired. I answered to the court and to the attorney
Both the court and attorney received the answer on Nov 3th. I received a Notice of case management conference which was issued on the same day the court and attorney received my answer. I'm wondering if the courts work that fast or could it have been sent out prior to receiving my answer to the complaint. Last activity on this account was July 2001. Someone else posted online that if you are court ordered then it sets the statue of limitations. At what point do they consider court ordered. Any adivise would be appreciated
Thanks,
JM

We don't know the facts on the case so we can't answer your question. There is an issue as to when the clock begins to tick with regard to a claim, whether "tolling" or delaying the clock applies, etc. This is fact based. Regarding the notice, I hae no idea. The courts don't work so quickly in general and it's possible it may have been generated prior to your answer. We can't see the paperwork.
