Statutory Civil Damages Claim

Hello,

A couple months ago I was leaving a (food) Store and brought my own tote bag. I didn't realize there were some items in the bag that I had forgotten to pay for. They apprehended me and brought me to the back of the store. I was told I could not return to the store, but the police were not called and no charges were filed against me.

A couple months later, I received a SETTLEMENT OFFER from (deleted) asking that I pay $217.50 and then I will receive a written release of the statutory civil damages claim. I have never shoplifted (or committed any crime for that matter) but was very frightened by this letter so I went ahead and made the payment. I am now frightened that further legal action will be taken against me by (food store)and/or they will request finger printing and a court date. Is this likely? Any advice?

Thanks so much for your time,
Drew

I removed name of store & other "personal info" originally - another moderator later removed the 2nd thread you started. Betty3

This was apparently a civil demand letter. Since you paid it (I hope you kept proof), the store most likely will not take any further action. It seems the police were not involved originally. Stay away from the store as you were told to do. This should be over for you & no further action pursued by store.

I am a retail theft consultant and answer questions like yours daily. The store has NOTHING to gain by filing a criminal complaint at this point so you can relax. By the way according to the law you DID shoplift
