My dad was caught at Walmart because he forgot to paid for the wine, which cost $20. He explain with us that he tried to hide the wine from my mom. And after walk around he fogot he had a bottle of wine in the pocket under jacket. He from another country and can not speak English language. We are on the processing for his and his wife greencard. He need to go to the court in next month and the police said " Steal under". Is that affected his greencard situation? Is the USCIS can denied his case? And is this affected his wife case cause we filed it togerther.
And if he go to the course, does he need to go to the jail? Or what maximum we need to paid for?
Please help us to finger out. Thank you so much

First off it was very unwise to name store on public forum and is not required for answers. Your Dad needs to consult an Attorney to see what options he has to protect his interest. He should ask about options like ACD or Diversion

Agree, I would have him consult with a criminal or immigration attorney - believe I would try an immigration attorney first.

It is very possible your dad can come away from this with no criminal record and no effect on immigration status.
Obtain a lawyer or ask for one when he goes to court. They will help him through it.
