My employer has accused me of stealing with 2 other employees. He said he was going to keep my paycheck until I pay him back. He has no evedense of this he said that there are 3 employees telling him this. Is he allowed to keep my paycheck without proof of me committing this crime?

When the police come calling after you've filed your wage claim, make sure you say, "I wish to exercise my right to remain silent. I need a lawyer."

Many tricks might be employed, just be polite and keep saying, "I wish to exercise my right to remain silent. I need a lawyer."
 
The above posts are correct; he cannot legally hold your paycheck.

However, he CAN fire you - even without proof or evidence of theft, and even if you are innocent of the theft.

So I'd be brushing up on my resume and starting a job search.

How much is he asking you to pay?
 
If you are fired, I would go ahead & apply for unemployment ins. You "might" receive it for "suspected theft" -the state will decide if you qualify.
