Stepchild in probate case

Does a stepchild have any fighting chance against an estranged "biological" daughter who after 25yrs of no communication just happened to contact the deceased a month before his passing. He has no will, stepchild did pay for the cremation but ashes are not being released to anyone while the estate is in probate.

Does a stepchild have any fighting chance against an estranged "biological" daughter who after 25yrs of no communication just happened to contact the deceased a month before his passing. He has no will, stepchild did pay for the cremation but ashes are not being released to anyone while the estate is in probate, its been 11 months.

The law does not care how often the child visited or how close they were. There isn't some magical tally where the one who did the most or visited the most or was the favorite wins the estate. The law does not care. If the deceased wanted someone other than the biological child to inherit, they would have made a will and granted others whatever property they intended them to have.
