My Stepfather married my mother when I was 6 years old, I'm 35 now and he recently passed away. My mother passed away 10 months prior to him. He had no will, and now the probate attorney is requesting i provide legal proof that he adopted me. From the time I was 7 or 8 years old I have had his last name, I have his last name on my CA DL, my Social Security Card and my US Passport, however my birth certificate still has my last name when I was born.

What can I do or what form can I give to the probate attorney proving he was my only "father" growing up and we share the same legal last name if he didn't formally adopt me?

PLEASE HELP!!

My condolences on your losses, your mom, then your stepdad.
There are no forms that you, or anyone could use to prove you were adopted, other than the court order indicating he adopted you. If you don't have the original court ordered adoption, a copy can be obtained from the clerk of court or county recorder.

However, you told us you weren't adopted. If that's true, without a will bequeathing stuff to you, you aren't a relative able to inherit his stuff through intestate.

I wish you well.
