ok if someone takes a check and tries to cash it but, doesnt get anything out can that person get into trouble if the other person finds out and presses charges?

Depending on the circumstances, it would probably be criminal attempt. It is the same as if you would try to pick someone's pocket and either it is empty or you get caught before you can grab the money. You will still be guilty of attempt.
