stopped check how can I get my money back??

I sold a couch and loveseat at $300 plus $50 for delivering. After getting there the consumer gave me $200 cash plus $100 check and asked if I would deduct $50 for cleaning. I accepted. 25 minutes later she contacted me wanting me to go back to get the furniture because she claimed the couch stunk. But you would have noticed that within the 15-20 minutes we were there. I declined after she called me a liar and told me that no good would come to me. I declined to do further business with her. I have all proof texts, voicemails and the actual check. She stopped payment on the check and wanted to keep the loveseat and give me the couch while I gave her $200 back. So here is the math. $350 -$50 for cleaning= $300-$100check stopped=$200 which she wanted back plus keep the loveseat. So other words a free loveseat and free delivery. So how can I get my rightful money back? She still has the furniture but has not tried to get it back to me. I offered to help her sell it at the price she bought it for. she declined, what can I do? Give me advice how to get my rightful money and make her responsible for all costs. thank you
 
You can take her to small claims court to sue her for what you believe she owes.
 
Yep... pretty simple small claims case. You can ask the judge to have her reimburse you for the court fees as well.
 
Know this about small claims, it isn't instant justice.




You can also file a complaint with the police.

In some states and counties, you can take the check to the prosecutor.

They'll collect the check for you, or they'll file criminal charges against her.

That costs you nothing, if your county does it, and the collection rate is nearly 99%!!!

The fact that she still has the goods and stopped the check could also amount to criminal charges.

Speak with your local county attorney or prosecutor.

I want to thank each of you for taking your time to help me. I will be taking her to court. Even if it isn't instant justice at least justice will be served. She has tried to take advantage of me and now will learn that there are consequences in this world and not everything will be given to her as she may wish. Once again thank you so very dearly.
