I have been renting a storage space at a "National" storage facility (UHaul) since September of 2007. The rental fee for the unit ($160.00/month) has been automatically charged to my credit card the 1st of each month. Therefore, not once has the due amount been even 1 day late. I discovered today after going to the facility for the first time since September that all of my belongings were auctioned off in January 2008. I will say that the contents of my storage were valuable both monetarily as well as sentimental. Needless to say, the amount is above a small claim.
The "clerk" at the facility showed everything on my account to be in order, never a late payment etc... And could not explain the reason for the auctioned off items, only the simple fact that the specific unit contents were auctioned at the above mentioned date. The only thing he could do was try and get in touch with the owners and have them call me as they are currently on vacation.
Even taking into consideration that the monthly rent has been continuously paid, accepted and posted to the account at that facility. Never once was I made aware via a telephone call or written notice of deliquency or intent to auction. I double checked all of their documented records such as phone number, current address EVERYTHING they have is accurate.
Do I have a case? If so, should I consult a Real Estate Attorney regarding this matter?
