I recently moved out of my apartment, and signed a sublet agreement to allow another person (2 people actually) to live there for the remaining 4 months on my lease. In addition to the landlord's sublet agreement, which basically just stated that they could live there in my absence, I asked them to sign another contract stating exactly what they were responsible for paying - this included a half-month's rent for March, and a full month's rent for April, both due by the first of April - to be paid directly to the landlord. I received a notice on the 5th of April that my rent account showed an overdue balance, and I've contacted the subletters several times, by e-mail, telephone, and in person, and each time they have another excuse, someone's out of town, they drove down to florida to pick up a car, they're sick, and they say that they'll pay the rent the next day. The last several times i've stopped by, the person who has answered the door (who isn't on the sublet agreement, and claims to be a friend using their computer), tells me they're not home, even though i distinctly heard them talking before i knocked.
What can I do? I'm being charged late fees on the rent, and since the lease is still in my name, and they're only subletting, i'm still ultimately responsible for paying it, and all the late fees that they're accruing if they just never pay. Can I make them leave and sublet to someone else? What rights do they have to stay, and what rights do I have to make them leave?? Can i just say they have to be out in a week and change the locks?
