sued by captial one

hey guys-

okay, so i have been struggling with this lawsuit slapped on me by capital one. . . the origional amount was $400 and now it;s up to over $1,000. the lawyer claiming to represent the company started out coming after me by calling me at work and leaking personal information to my co-workers ('who do i contact to garnish her wages?'). when that happened i sent a letter requesting that they stop calling and deal with me through the mail, which they replied to with a statement of the account. i sent back a letter giving them permission to take $25 a month out of my bank account to go towards the bill, which was ignored. then i was served with papers stating that they were suing me for 'refusal to pay'. so, i have tried to contact the law office, they will not return my calls. i called capital one bank, they claim to have no record of a lawsuit being filed. i called the lawyer again, asking who the plaintiff really was on the lawsuit. . . nothing. i am now going to send a certified letter with my intention of making payments toward this account. . . i obvioulsy do not want my wages attached! any advice out there???

I'm not an expert or an attorney but I'd question a few things. Have you actually been served? If you have been served you will have an official document stating when the court date is. Or is this just a letter from a bill collector who also happens to be a lawyer? Try calling the original creditor and make arraignments to pay them the $25 a month. If the debt was sold to a collection agency you will have to deal with them, or their attorney. But if it was just assigned to them you can still settle this with Capital One. Call Capital One and try to work out a payment plan.
 
I was served papers. . . i did call capital one, they have no record of a lawsuit, and the lawyers office will not return my calls. It's fishy. . .
