I've been summoned to appear in court by a creditor because i've failed to respond to their calls and notices regarding payment arrangements. I've researched several means and made several attempts in the past to repay not just this one account but others as well and failed to continue because the financial burden became to great. My question is, "What will happen after I appear in court and report to the county clerk in response to my creditor that I can not pay the full $2,739.34, But am willing to pay $ 100 a month. Will the attorneys that is working on the creditor behalf be willing to except that from me?

Nobody can tell you. It's their choice. Chances are they will be willing to make some deal with you but if it takes them 3 years to get their money... they may want a better deal. They will also likely want certain penalties if you default. Why not call them and see what you can work out.

hope you can take law professor advice

i do agree with law professor. its their choice of making decision its not up to you to decide the solution for the issue its up to them. but i can understand your problem you can better talk with your creditor and try to convince him for the late and partly payments.
