Hi, I currently live in Chino Hills, California.. I recently had a parking incident involving my car at a hotel in San Diego (about two hours away), and the hotel was at fault, but now denying liability. I am now going to file in small claims court against the hotel. I have read and tried to do research about the steps, but please tell me if my understanding to the steps are correct:

1. I am going to print and fill out form SC-100
2. File this form in small claims court and pay the filing fee (do I need to do this in MY county? or the county of the hotel I am suing?)
3. Hire someone in San Diego (where the hotel is) to serve the hotel these papers (form Sc-100)
4. I then wait for the court to respond to me with a date?

Does that sound correct?

thanks, first time suing obviously.

You need to file in the county where the incident occurred.
The court can explain to you the process, but you are on the right track.

So the first thing I do is mail form Sc-100 to the San Diego courts? Besides my filing fee, what else do I need to send In? And the next point after that, will the courts mail me the court date? Or what happens next?

Then Once the courts set a court date, how do I mail the paperwork as certified to the hotel? I understand that the hotel can be "served" by certified mail? Lastly, who exactly am I suing on the paperwork? The hotel managers name? (It is a huge hotel chain)

Thanks

Brandon

What was the parking incident? Is there a valet service separate from the hotel running it? Who owns the lot it happened in?

It's best to let YOUR insurance company do this by filing a claim.
You'll soon discover the small claims court process to be less than fulfilling and very unrewarding.
