Depends what he's suing for. If his possessions got damaged, then yes. Otherwise, the person who actually suffered the damage should be the one to sue. The family member could act as agent on their behalf.
 
The claim was filed for damage to a home by a tree limb. If the house is not in his name, can he still bring a case to small claims?
