I have a friend who gave me a key to her house and I had went to check on her dog for her a few times. Anyway another friend of mine who knows the first friend too. got angry with me back in Jan. of 2009, shoe told the first friend that I went into her house and stole an XBOX 360, some games, some rolex watches and some shoes. now this person claims her neighbors have it on video. First off the last time I was at her house was about a year ago, and she never said anything to me about this video or taking her stuff. about a year ago I used the key she gave me to go in and check o her dog for her. I had taken in some dog food and toys and blanket in a bag, I came out with same bag I took the stuff in with, and the angry friend knew I went over and took the stuff etc. we were close and talked about everything. So anyway, she gets mad at me a few months ago and now had told all kinds of people lies about me and now all the sudden the first friend I all angry and threatening to take this video to cops. First can she press charges, does she even have a case as I sued the key she gave me to go inside, and if there is even a video tape, is the a statue of limitations on how longs she has to use that to press charges? I have talked to her several times since the last time I was at her house, the angry friend didn't like the first friend to begin with and caused problems for us so we stopped talking as much. But I had talked to the first friend several times since the last time I was at her house and she never mentioned this tape until today, and I did not take any of her stuff but the angry friend has told her I did and now first friend says she saw the tape months ago and was waiting for me to tell her I took her stuff. is ther any advise you can offer for this situation?

First can she press charges,
She can report it to the police and ask that you be charged, and the police can forward the report to the DA. The DA will decide whether or not to pursue charges.

does she even have a case as I sued the key she gave me to go inside,
Sure she has a case. And if you entered with a full bag (with a blanket and dog food) and left with the same bag, it might look suspicious. After all, who is to say that you did not put the stolen goods in the bag?

Will the video be damning? Not if you had permission at the time to go in. But, when taken with other evidence, statements, or information, it might be enough to make a good case. It really depends on what other evidence they might have against you. Hopefully you did not magically appear the next day with an XBOX.

and if there is even a video tape, is the a statue of limitations on how longs she has to use that to press charges?
The times covered under statutes of limitations vary by state. But, most felonies are typically measured in years. One year passing is not likely to let you off the hook.

If she never reported the items as stolen a year ago, then chances are this case will be a waste of time for the prosecutor. If there was a report, and they are only now bringing out the tape, then it could spell trouble for you.

It is up to you if you want to talk to the cops or not. If the cops come knocking, you DO have the right to decline to speak with them. And, if charged, consult an attorney ASAP.
