Taking a custodial parents rights away

My 16 yr old step-son turns 17 in 4 months. His mom walked in on him while having personal time in his bedroom. She then took his phone, that his dad (the custodial parent) was letting him use, and proceeded to "go through it". She found pictures of naked women that were jokes that his dad forwarded to that phone. She now wants to use the phone as "evidence" ungainst my husband. We're not sure what she's planning to take him to court for, except maybe to attempt to take custody away. When the boy was 7, she told the police his dad had "bad pictures of kids" on his computers. It was nothing but far from the truth, but still the police invaded, arrested, and seized. We now have 4 young children in our home and are afraid she may be planning something again. What can we do to protect ourselves and does she even have some kind of case? Plus, she gave us custody 1 yr ago when she moved in with her boyfriend, now they broke up. The day she started this stuff.
 
Your husband could be in deep dog doo doo! He sent provactive images and texts to a minor!! This could mean felony charges!! It could also impact any children living in the home. You may be forced with a choice of removing your husband or having children's services remove your children!!
 
I have to agree, if he is sending provocative images to his son's phone, he could be guilty of a criminal offense. All this will do will be to revive the prior claims of inappropriate conduct and could very well result in his losing custody, if not criminal charges. Your husband (dad) would be well served by consulting legal counsel first thing Monday morning.
 
The fact that a father send his minor son photos of naked women as a joke is disturbing. Child custody may be impacted as it does show significantly poor judgment on his part. If CPS does get involved, it could come down to you needing to make a choice between husband and children.

Also, if any of those naked women were minors...
