My husband's former employer has neglected to provide us with necessary documentation for a tax year that he is being audited for. We have requested it several times in the last 6 months, and the HR person keeps giving us the run-around. When I contacted her most recently, she basically told us that she was not going to get the information for us. Do we have grounds for any legal action (seeing that we will ultimately have to pay the IRS if we are not able to provide these documents).
 
That depends.

If your husband has NEVER received this information, then he has recourse.

If he is asking for duplicates of information he has already received, he does not.

They are required by law to provide the information at the time it is due.

They are never required by law to provide duplicates.
