Tenant died. How do I file claim against estate?

I live in Oregon and my tenant died last month (also in Oregon). There was rent due, late fees and significant damage to carpet and other misc in the house. How do I file a claim against her estate? The son is at Camp Pendalton, so father of son (ex-husband?)in Calif is taking care of paperwork. I gave him my estimates for damages and balance due is over $3,000.00 - How do I know he won't just throw away my papers and I never hear from him again? Shouldn't I be filing this claim forally somewhere? thanks, Carol

Is there an estate with any money in it? You can check with the probate court to see if anyone has started probate. If not ask the clerk about you starting probate. Then you will have to try and collect.
