I am currently living in a 1 bedroom apartment building owned by a well known rental agency throughout Canada. I have been here since Aug 2007 so just about a year and a half. We have finished our 1 year contract and now are on a month to month basis.
Here is my situation: More than a month ago (36 days ago now) there was a pipe that burst in the unit next to me which ended up draining water into my bedroom. The landlord of the building was informed and although it was a given that my apartment was affected (along with many, many other tenants) by this flood, I reported the leak into my bedroom just to be on the safe side. He told us to move out everything from the bedroom for they are going to have to replace the carpet and such. They came the next day and took out the carpet, dried the ground under and checked the air for any mold residue. This process took about a week and a half but since then nothing has been done. I do not have any carpet in my bedroom all my belongings from my bedroom is in every corner of my livingroom and even in my kitchen (the whole apartment is only 700 sq. ft.) and I have been sleeping in my livingroom since then. I have tried going to the landlord of the building and he has done nothing but told me to call the head office which I have done and left messages, with only 1 message being replied, in which they came and inspected the damage done and 2 weeks later here we are again nothing is being done.
I would just like to know what my rights as a tenant in this situation is? I know I am entitiled to a rent reinbursment and they have offered to move me to another unit but we are busy people. We are in school and both work almost full time and I do not believe that I should have to move units for a situation that should be handled right away.
Any advice is greatly appreciated!
