Tenants have refused to vacate

I have tenants that were given 30 days written notice to vacate property as per the lease. I was informed today that they will not be vacating timely and plan to drag their eviction out through the court as long as possible. We have sold the house, that is why we are terminating their lease, they knew this could happen but are not in a position to go anywhere else. They have not paid all of October's rent can we start eviction proceedings prior to the end of their 30 day notice, (ie, tomorrow for non payment? or rent) THANKS

If they have told you they intend to overstay their lease yes you can start the eviction process immediately.

Failure to surrender the premises at the end of the lease is one of the reasons to initiate an eviction in Georgia. The attached provides information on how to file for this:
